Family Sponsor – Temporary Sponsored Parent (Subclass 870) Visa

On 17 April 2019, a new family sponsorship framework has been established creating a new class of family sponsor called a ‘parent sponsor’. At the same time, a new Temporary Sponsored Parent (Subclass 870) Visa (TPSV) has been created for the parents of Australian citizens, Australian permanent residents and eligible New Zealand citizens.

This new visa will promote temporary family reunification and enable parents, sponsored by their adult Australian citizen, permanent resident or eligible New Zealand citizen children, to visit Australia for up to five years.

However, eligibility to apply for a TSPV will be contingent on the parent having an approved parent sponsor.
Households are limited to one sponsorship for a TSPV at a time.

Who can Sponsor?

A person who is:

An Australia citizen; or
An Australian permanent resident or an eligible New Zealand citizen who has been usually resident in Australia for at least the 4 years immediately before the application is made.

Who can be Sponsored?

Biological parent.
Step-parent.
Adoptive parent.

Eligibility Criteria for Approval as a Parent Sponsor

Be at least 18
Satisfy as to your identity.
Pass the income test. Minimum yearly income requirement is set at $83,454.80
Meet the conduct requirements. There are three conduct requirements namely adverse information, police check and satisfaction of sponsorship obligation
Meet the outstanding public health debt requirement. A person cannot be approved as a family sponsor if he, his partner, the person he is seeking to sponsor or any parent he has previously sponsored has an outstanding public health debt and the appropriate arrangement has not been made for the payment of the debt.

Agree to share and disclose information provided as part of their application, with parties specified in the application

Number of Applicants that can be Sponsored

Up to two visa applicants can be included on the sponsorship application.

When Approval of Parent Sponsor Ceases

When the sponsor’s permanent visa is cancelled.
The sponsor dies.
The sponsor withdraws their sponsorship.
The sponsored person does not apply for the Subclass 870 visa within 6 months after the sponsorship approval.
The sponsored person’s subclass 870 visa ceases.

Obligations of Parent Sponsors

Obligation to support sponsored person financially and in respect of accommodation.
Obligation to pay outstanding public health debt of sponsored person.
Obligation to keep records.
Obligation to give the record to the Minister.
Obligation to give information to immigration when certain events occur.
When the sponsor’s permanent visa is cancelled.
The sponsor dies.
