Family Sponsor – Temporary Sponsored Parent (Subclass 870) Visa

On 17 April 2019, a new family sponsorship framework has been established creating a new class of family sponsor called a ‘parent sponsor’. At the same time, a new Temporary Sponsored Parent (Subclass 870) Visa (TPSV) has been created for the parents of Australian citizens, Australian permanent residents and eligible New Zealand citizens.

This new visa will promote temporary family reunification and enable parents, sponsored by their adult Australian citizen, permanent resident or eligible New Zealand citizen children, to visit Australia for up to five years.

However, eligibility to apply for a TSPV will be contingent on the parent having an approved parent sponsor.
Households are limited to one sponsorship for a TSPV at a time.

Eligibility Criteria

You must be in one of the following situations:

  • You intend to undertake medical treatment (including consultation) in Australia.
  • You intend to donate an organ to someone in Australia.
  • You intend to accompany a person who intend to undertake medical treatment or intend to donate an organ to someone in Australia.
  • You intend to receive an organ from someone who travels to Australia with you
  • You intend to come to Australia under the arrangements between the Western Province of Papua New Guinea and the Queensland Department of Health.
  • You are in Australia, aged 50 years or older, and you have been refused an Australian permanent visa on health grounds only and are unfit to depart Australia.
  • You must have adequate means or access to adequate means to support your travel, medical treatment and other expenses related to your stay in Australia. This criterion does not apply to certain unsuccessful permanent visa applicants who apply for this visa in Australia
  • You must be a genuine visitor. This criterion does not apply to certain unsuccessful permanent visa applicants who apply for this visa in Australia
  • You must meet health and character requirements.

For applicants who are in Australia:

  • You must not have a “no further stay” condition imposed on your current visa unless that condition has been waived.
  • Section 48 of the Migration Act operates to bar applications for further visas by persons who: are in Australia, do not hold a substantive visa and, since last entering Australia, have been refused a substantive visa or, had a visa cancelled under certain provisions in the Act, unless that further application is for a specified visa. Applications for Medical Treatment Visa are not affected by the section 48 bar.
  • If you do not hold a substantive visa you must submit a completed Form 1507 – Evidence of intended medical treatment (including consultation) in order to make a valid application.

Benefits on This Visa

With Medical Treatment Visa, you can:

  • stay in Australia until the treatment plan or consultations are finished
  • be granted single entry or multiple entries to Australia depending on your situation
  • study for up to 3 months (or longer if you meet the exemption criteria)

How to Apply?

You can apply for this visa while you are in or outside Australia. If you are in Australia at the time of application, you must be in Australia at the time of grant. If you are outside Australia at the time of application, you must be outside Australia at the time of grant.

An application for this visa must be lodged online.

You can include your family members in your visa application. However, a separate application must be made for each member of your family, unless they are included in your passport.

Processing Times

Medical Treatment Visa applications may take less than a month to two months for processing.

Costs

The visa is free for applicants who apply from outside Australia or represent a foreign government. The visa costs AUD 290 for applicants who apply from within Australia.
