Notary Public

A notary public is a practicing solicitor or lawyer appointed by a State or Territory Supreme Court. In this capacity, the notary public is authorised to:

  • Prepare and attest legal documents; 
  • Certify the execution of documents; 
  • Administer oaths;
  • Witness affidavits, statutory declarations and other legal documents; and
  • Certifies true copies of original documents. 

 

The work of a notary public is recognised internationally, distinguishing  the role from that of a Justice of the Peace, whose authority is generally limited to domestic or local jurisdictions.

Mr Shahid Nadeem, the principal solicitor at Nadeem Lawyers, is a notary public.

Many notarised documents that would be sent overseas require certification by the Australian Department of Foreign Affairs and Trade (DFAT). DFAT manages the database that contains the official records of the signatures and seals of all Public Notaries in Australia. DFAT certifies the signatures, seals or stamps of a public notary to confirm that a document has been notarised by a public notary. This is done by issuing an Apostille Certificate or Authentication.

An Apostille is only recognised in those countries which are a party to the Hague Apostille Convention (officially known as the Convention of 5 October 1961 Abolishing the Requirement of Legalisation for Foreign Public Documents). If your country is not a party to the Hague Apostille Convention, then your notarised document might be required to get it Authenticated by DFAT.

In addition to the notarial work, we can also assist you with the Authentication of your notarised documents or with obtaining an Apostille Certificate by DFAT.
